Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the website at nuecrea.com and any related pages, content and enquiry forms (together, the “Site”), operated by Nuecrea Private Limited (“Nuecrea”, “we”, “us” or “our”), a company incorporated in India. By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
1. Who we are
Nuecrea is a multi-division firm operating Nuecrea Studio (design, web and app development, custom software and AI automation), Nuecrea Media (branding and digital marketing) and Nuecrea Realty (real estate advisory and marketing). The Site describes those services; it is not itself a service delivery platform.
2. Use of the Site
You agree that you will not:
- use the Site for any unlawful purpose or in breach of any applicable Indian law or regulation;
- submit false, misleading or third-party personal information through our enquiry form;
- attempt to gain unauthorised access to the Site, its servers, or any connected system, or interfere with its normal operation;
- scrape, copy, republish or commercially exploit the Site’s content without our prior written permission.
3. Enquiries are not a contract
Submitting the enquiry form, emailing us, or calling us starts a conversation — it does not create a client relationship, a binding engagement, or any obligation on either side. Work is undertaken only under a separate written proposal, statement of work or agreement signed by both parties. Where such an agreement conflicts with these Terms, the signed agreement prevails for that engagement.
4. No professional advice
Content on the Site is general information about our capabilities. It is not legal, financial, investment, real-estate, tax or employment advice, and must not be relied on as such. Property references, case studies, figures and results describe past work and are not a promise of comparable outcomes. Always seek advice tailored to your circumstances before acting.
5. Intellectual property
All content on the Site — including the Nuecrea name, logo, division marks, copy, layout, design, photography and code — is owned by or licensed to Nuecrea Private Limited and is protected by Indian and international intellectual property law. You may view and print pages for your own reference. Any other use, including reproduction, modification or distribution, requires our written consent. Third-party names and marks shown on the Site remain the property of their respective owners.
6. Third-party links and services
The Site links to external websites and relies on third-party providers (for example, our form-handling provider and font and hosting infrastructure). We do not control those sites or services and are not responsible for their content, availability or practices. Their terms and privacy policies apply to your use of them.
7. Availability
We aim to keep the Site available and accurate, but we provide it “as is” and “as available”, without warranties of any kind, express or implied, including as to accuracy, fitness for a particular purpose or uninterrupted access. We may change, suspend or withdraw any part of the Site at any time without notice.
8. Limitation of liability
To the fullest extent permitted by law, Nuecrea Private Limited will not be liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, data, business or goodwill, arising out of your use of or inability to use the Site. Nothing in these Terms excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence.
9. Indemnity
You agree to indemnify and hold Nuecrea Private Limited, its directors, employees and contractors harmless against any claim, loss or expense arising from your breach of these Terms or your misuse of the Site.
10. Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.
11. Changes to these Terms
We may update these Terms from time to time. The version published on this page, with the date shown above, is the version in force. Your continued use of the Site after a change takes effect constitutes acceptance of the revised Terms.
12. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of India. The courts at Chennai, Tamil Nadu shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Site.
